  • commonsense, No such luck. In the article it states that the Corps is going to handle this administratively. The worst he can get is Other than Honorable. If he request a court martial, which is his right to do, and he loses then all bets are off.

  • @Shellie actually armywife is very correct. That is the way the system works. The thing is when when they get in front of the court martial judge they had better have good solid evidence that the order they refused was unlawful.

  • Funny thing about all the talk here about rights, this Sgt has the right to defend his actions in a full court martial and appeal it all the way to Scotus. How much you wanna bet he takes his Article 15 and discharge and proceeds to whine about how he was treated?
